Appeals Process
- Request reconsideration or waiver of an
overpayment in writing from an RRB office
- Appeal to Bureau of Hearings and Appeals
- Appeal to the three-member Board
- Appeal to the U.S. Circuit Court of Appeals
- within one year if retirement/survivor
appeal
- within 90 days if unemployment/sickness
appeal
Notes:
- Appeal to Bureau of Hearings and Appeals - may be decided on the
basis of the written record or a hearing may be held by telephone,
videoconference, or in person. When held in person, the hearing is
usually held near the claimant’s home town so claimant doesn’t incur
large expenses.
- Appeal to Board - reviewed by the three-member Board on the basis
of the written record which may be supplemented.
- Employers have the right to protest unemployment-sickness claims of
their employees, but such protests do not prevent timely payment of
benefits. However, employees may be required to repay benefits if
their employers’ protests are successful. The employer also has the
right to appeal an unfavorable decision to the Bureau of Hearings and
Appeals.
